On September 2, 2015, the 16th Judicial District Court granted a Motion for Summary Judgment filed by The Monson Law Firm attorney Sarah Murphy Barro, ruling that Atain Specialty Insurance Company’s policy did not provide insurance coverage for the plaintiffs’ claims. In the case of “Brady and Erin Romero v. Marcus David Bonvillain, Jr. and Atain Specialty Insurance Company,” plaintiffs contracted with Marcus Bonvillain to build a new home. Plaintiffs ultimately filed a lawsuit against Mr. Bonvillain, and his CGL insurer, Atain, asserting claims for faulty construction. The District Court held that the Damage To Your Product exclusion in the Atain policy applied to exclude coverage for plaintiffs’ claims, as their entire home constituted Mr. Bonvillain’s “product.”
