The Monson Law Firm Wins Hurricane Isaac Summary Judgment

On August 7, 2015 The Monson Law Firm won summary judgment on behalf of Southern Fidelity Insurance Company in the case of “Douglas, et al v. Renola Equity Fund, LLC, et al.” The case is pending in United States District Court for the Eastern District of Louisiana. The court agreed that Southern Fidelity timely adjusted and rightfully paid its insured pursuant to the terms and conditions of the policy. In granting summary judgment, the court held that plaintiff could not carry his burden of proof that Southern Fidelity underpaid on his claim.

Marketing Director, Ann’Lee Earles, attended a continuing education class to stay up to date on her Louisiana Producer’s License in which she has the following Lines of Authority: Property, Casualty, Life and Health and Accident. She learned from guest speaker, Louis Fey Jr., CPCU, CIC, CRM, AIC, on the “Essentials of Cyber Liability.” Louis is the Vice President of Risk Management at BancorpSouth Insurance Services. The Monson Law Firm Claims Coverage Victory on Writs for Lighthouse Property Insurance Corporation

On August 21, 2015, the Louisiana First Circuit Court of Appeal granted a writ application filed by The Monson Law Firm attorneys Sarah Murphy Barro and Laura Abel, ruling that the Lighthouse Property Insurance Corporation’s policy did not provide insurance coverage for the plaintiff’s claims. In the case of “Michelle Petsch v. Geanne Petsch, Peter Petsch and Lighthouse Property Insurance Corporation,” plaintiff, the daughter of the insured, lost several toes while operating a lawnmower on her parents’ premises. Plaintiff claimed that she was a resident of another premises. The Louisiana First Circuit Court of Appeal overturned the trial court’s denial of Lighthouse’s Motion for Summary Judgment, holding that because plaintiff also maintained a residence at her parents’ property, she was an insured under the policy and her claims were excluded from coverage.  Please click here for a copy of the decision.
