Glow Ball Golf Tournament

The Monson Law Firm participated in the Young Insurance Professionals of Louisiana’s 2015 Glow Ball Golf Tournament in Lake Charles. The four person scramble started with 9 holes of golf in the daylight followed by the last 9 holes played in the dark with glow balls. Live Burn Demonstration

The Monson Law Firm Wins Summary Judgment for Southern Fidelity Insurance Company

The  32nd Judicial District Court recently granted a Motion for Summary Judgment filed by The Monson Law Firm attorney Sarah Murphy Barro, ruling that Southern Fidelity Insurance Company’s insurance policy did not provide insurance coverage for the plaintiffs’ claims.  In the case of “Phillip Ryan Hearn, Individually and on Behalf of his Minor Child, Peyton Rylee Hearn v. Randy Babin and Tammy Babin, Individually and on Behalf of Phillip Babin, and ABC Insurance Company,” plaintiff Peyton Hearn was injured while riding with defendant Phillip Babin on an All-Terrain Vehicle.  The plaintiffs ultimately filed a lawsuit against the Babins and their homeowners’ insurer, Southern Fidelity, asserting various causes of action, including vicarious liability, negligent supervision, and negligent entrustment.  The District Court held that Southern Fidelity did not provide insurance coverage for the plaintiffs’ claims because the Babins’ policy contained an All-Terrain Vehicle Exclusion and Motor Vehicle Liability Exclusion which excluded coverage.

Micro Invasive Therapies for Pain Management

The Monson Law Firm attended the North Shore Claims Association’s November lunch meeting at Friends Coastal Restaurant in Madisonville. We learned from guest speaker, Dr. Chad Domangue, on the topic of Micro Invasive Therapies for Pain Management. Dr. Domangue is one of only 200 neurologists in the country and the only one in Louisiana to be trained in interventional pain management. Certified Workers’ Compensation Professional Program

The Monson Law Firm would like to congratulate Laura Abel, Esq. for receiving her Certified Workers’ Compensation Professional Program (“CWCP”) designation.  Laura successfully completed 40 hours of workers’ compensation courses, which encompassed all aspects of effectively handling and litigating a workers’ compensation claim.  Congratulations to Laura on this great achievement! The Louisiana Commissioner of Insurance, Jim Donelon, spoke to the Association about the upcoming election and updated us on the new laws and regulations for the Louisiana insurance industry. The Monson Law Firm Wins Summary Judgment for Auto Insurer and Insured Driver in Pothole Case

On September 11, 2015, the Civil District Court for the Parish of Orleans granted a Motion for Summary Judgment filed by The Monson Law Firm attorney Blake J. Lusk, ruling the insured driver was not negligent in the operation of a motor vehicle.  In the case of “Dana R. Williams and Derrick E. Sykes v. Archer Western Construction, LLC, Arch Insurance Company, Imperial Fire & Casualty Insurance Company and Eileen Maldonado,” plaintiffs were guest passengers in a vehicle being operated by Eileen Maldonado when it drove into a large pothole. The pothole was alleged to be the result of road repairs being performed by Archer Western Construction. Plaintiffs made claim against Eileen Maldonado, and her insurer, Imperial, asserting that the accident was caused by Eileen Maldonado’s negligence.  Despite opposition from both co-defendants and plaintiffs, the District Court held that Eileen Maldonado was not negligent in the operation of the motor vehicle.  Accordingly, plaintiffs’ claims against Eileen Maldonado and Imperial were dismissed with prejudice.
